Privacy And Cookies Policy (“Privacy Policy”)

This Privacy Policy serves as essential information about the purposes, methods of processing and
the security of your personal data as users of the website: motives.hr (hereinafter referred to as the
Website).

By getting acquainted with this Privacy Policy, you are provided with the information on who is the
administrator/ controller of your personal data, what personal data is collected by the Website,
purposes for which it is used and how it is protected.

This Privacy Policy is an expression of our concern for the rights of visitors to our Website and those
who use the services provided through this Website. It also fulfills of the information obligation arising
from Article 13 of the Regulation (EU) No. 2016/679 of the European Parliament and of the Council of
27 April 2016 on the protection of natural persons with regard to the processing of personal data and
on the free movement of such data, and repealing Directive 95/46/EC (General Regulation on the
Protection Personal Data) (OJ EU L119 of 4/05/2016, p. 1) (hereinafter referred to as the GDPR).

As the owner of the Website, we pay particular attention to respecting the privacy of its users. The
data obtained through the Website is particularly protected and secured against unauthorized access.
The Privacy Policy is made available to all interested parties. The Website has an open character.

As the owner of the Website, we ensure that its primary goal is to provide its users with privacy
protection that is at least equivalent to the requirements of the applicable laws, in particular the GDPR
and the Act of July 18, 2002 on the provision of electronic services.

As the owner of the Website, we may collect personal data and data of another nature for the
purposes indicated in this Privacy Policy. The collection of this data occurs, depending on its nature
either automatically or as a result of actions taken by visitors to the Website.

By using the Website, the individuals accept the principles set out in this Privacy Policy.

3. PDC processes your personal data in accordance with the following principles:
(i) on a legal basis and in compliance with the law (legality);
(ii) honestly and fairly (fairness);
(iii) transparently for the data subject (transparency);
(iv) for specific purposes and not “in case” (minimization);
(v) no more than necessary (adequacy);
(vi) with care for the data accuracy (accuracy);
(vii) no longer than necessary (timeliness);
(viii) ensuring appropriate data security (security).

§2. Purposes, Legal Bases and Scope of Data Processing

  1. PDC will process your personal data for the following purposes:
    (i) for contact purposes, to respond to messages sent directly via e-mail or through a form, based on PDC’s legitimate interest in need to provide a response;
    (ii) for technical purposes using technical cookies (session cookies), based on the PDC’s legitimate interest in the proper operation and functioning of the Website;
    (iii) for statistical and analytical purposes, if you have given your consent for PDC to use cookies for analytical purposes (analytical cookies);
    (iv) for marketing purposes, if you have given your consent for PDC to use cookies for marketing purposes (marketing cookies);
    (v) for purposes related to maintaining PDC’s corporate profile on social media in accordance with the rules defined by the owners of the respective medium (portal) and providing information about PDC’s products, promotions and other information related to PDC’s activities, which PDC considers its legitimate interest.
  2. Your data will be processed to the following extent:
    (i) If you send an e-mail message, PDC will process the data contained in the e-mail. Providing your personal data in an e-mail is voluntary. You can request PDC to delete this data at any time.
    (ii) If you use the contact form on the PDC Website, PDC will process data in the form of your e-mail address and names. Providing this data is a condition for PDC to respond to your inquiry.
    (iii) Providing your personal data is voluntary but necessary for responding to an e-mail or a request submitted through the contact form.
    (iv) Other data processed by PDC includes the IP address and other data stored in cookies. You decide to what extent PDC can use cookies with your data. Providing data to PDC in this way is voluntary. You can change your preferences at any time. This can be done in your web browser or by deleting cookies stored from the PDC Website.
    (v) If you like or otherwise engage with PDC’s profile on social media (e.g., Facebook), PDC will process your data provided in that medium and to which PDC has access. To stop the processing, you can unsubscribe from PDC’s profile.
    (vi) External partners’ APIs: The PDC Website may use APIs (application programming interfaces) provided by external partners to integrate various functionalities such as maps, analytical services, advertising, or social media. Using these APIs may result in the creation of additional cookies or the use of existing cookies to process user data. External partners may store and process this data in accordance with their own privacy policies.

§3. Data Recipients and Intention to Transfer Data
Outside the EEA or to an International Organization

  1. Recipients of your personal data are:
    (i) If you have given consent for marketing cookies , your data stored in cookies may be shared with PDC’s advertising partners;
    (ii) if you have given consent for analytical cookies, your data stored in cookies will be processed by the entity providing traffic analysis software for the PDC website (e.g. Google Analytics).
  2. Your data will not be transferred to countries outside the European Economic Area (EEA) or to international organizations, except for the partners listed below:
    (i) Google Inc. based in the USA for traffic analysis on the Website using Google Analytics and providing additional features (such as Google Maps , Google Search Console ) related to the proper functioning of the Website and displaying search results (See : how Google processes and protects data. ).
    (ii) Google Inc. based in the USA for advertising and measuring its effectiveness through Google Ads (See : how Google processes and protects data).
    (iii) Facebook Inc. based in the USA for managing accounts and access to data on social networking sites (Facebook, Instagram), advertising and measuring their effectiveness related to the installation of the Facebook pixel and the Conversion API on the website.   3. Your data will not be used for profiling.

§4. Data Retention Period

PDC cannot determine the specific period, for which it will process your personal data. If you have
provided your data in a contact form or e-mail message, your data will be processed until you request
its deletion or object to its processing, but also once the PDC believes that its legitimate interest has
been fulfilled, no longer, however, than for a period of 12 (twelve) months, or for the period resulting
from legal provisions that oblige the PDC to retain personal data for a longer period of time.

§5. User rights

  1. In connection with the processing of your data, you have the following rights:
    (i)access to the content of your data;
    (ii) he right to rectify, erase, or restrict processing;
    (iii) the right to transfer data;
    (iv) the right to object;
    (v) the right to withdraw consent to their processing at any time and in any form, unless the processing of your data takes place in order for the PDC to perform its obligations to you, to comply with legal obligations towards government institutions, or to pursue PDC’s legitimate interests under the law.
  2. You have the right to request PDC’s immediate deletion of your personal data, and PDS is obligated to promptly erase personal data if one of the following circumstances applies:
    (i) the personal data is no longer necessary in relation to the purposes for which it was collected or otherwise processed;
    (ii) the data subject has withdrawn consent on which the processing is based;
    (iii) the data subject has objected to processing under Article 21(1), and there are no overriding legitimate grounds for the processing.
  3. You also have the right to lodge a complaint with the President of the Office for Personal Data Protection (at the address of the Office for Personal Data Protection, ul. Stawki 2, 00-193 Warsaw).

§6. Cookies Policy

  1. Cookies are used on the PDC Website. Cookies are computer data, specifically text files, which are stored on the end user’s device and are intended for use with the Website’s web pages. The accessed resources are identified by URL addresses. The precise list of information stored in the server logs is as follows:
    (i) the public IP address of the computer from which the request originated,
    (ii) the client station’s name – identification conducted by the HTTP/HTTPS protocol when possible
    (iii) the name of the service user provided during the authentication (login) process,
    (iv) the time of the request’s arrival,
    (v) the HTTP/HTTPS response code,
    (vi) the number of bytes sent by the server,
    (vii) the URL address of the page previously visited by the Website user – in case the transition to the service was made through a link from another page,
    (viii) information about the user’s internet browser,
    (ix) information about errors that occurred during the execution of HTTP/HTTPS transactions.
  2. The above data is not associated with specific individuals browsing the Website within the service. To ensure the highest quality service, the owner of the Website occasionally analyzes log files to determine which pages within the service are most frequently visited, which internet browsers are used, whether the page structure contains errors, etc.
  3. The collected logs are stored indefinitely as auxiliary material for the proper administration of the Website. The information contained in them will not be disclosed to any other entities except the operator or entities associated with the operator personally, financially, or contractually. Statistics that aid in the administration of the service may be generated based on the information contained in these files. Summaries containing such statistics do not contain identifying characteristics of individuals visiting the service.

PDC reserves the right to make changes to this Privacy Policy. Such changes may be necessary or
required, for example, due to changes in legal regulations, new guidelines from supervisory
authorities, changes in the technology used by PDC for processing personal data, as well as changes
in the methods, purposes, or legal bases for processing personal data by PDC.
